What is a Tree Preservation Order (TPO)? A Tree Preservation Order (TPO) is an order made by a local planning authority in the UK to protect specific trees or a particular woodland from being cut down, uprooted, or otherwise destroyed without the local planning authority's written consent. They are put in place to protect trees that provide amenity value to the local area.
How do I find out if a tree has a TPO? JDB can check if a tree is protected by a TPO by contacting your local planning authority (usually the planning department of your local council). They maintain a register of TPOs.
Can I prune or remove a tree with a TPO? No. You must apply to your local planning authority for written consent before carrying out any works (pruning, felling, etc.) on a tree protected by a TPO. Unauthorised works on a TPO tree can result in significant fines. JDB can assist you with the application process.
What is a Conservation Area? A Conservation Area is an area of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance. Many trees within Conservation Areas are automatically protected, even without a TPO.
Do I need permission to work on trees in a Conservation Area? Yes. You generally need to give your local planning authority six weeks' notice of your intention to carry out works on trees in a Conservation Area. This allows them time to consider whether to make a TPO to protect the trees permanently. As with TPOs, unauthorised works can lead to penalties. JDB can assist you with the application process.
Do I need a tree survey for a planning application? Often, yes. If you are submitting a planning application for development that involves trees on or adjacent to your site, your local planning authority will likely require a tree survey compliant with British Standard 5837:2012 'Trees in relation to design, demolition and construction – Recommendations'. This survey assesses the trees' health, value, and impact of the proposed development.
How do I know if my tree is healthy? A healthy tree typically has vigorous leaf growth (in season), good branch structure, and no obvious signs of decay, fungal brackets (mushrooms), or significant dieback. Discoloured leaves, sudden leaf drop, bark abnormalities, or dead branches can be indicators of problems. If you're concerned, it's always best to have a professional arborist assess your tree.
What are the common signs of a dangerous tree? Signs of a potentially dangerous tree include:
What is pruning and why is it necessary? Pruning is the selective removal of branches from a tree. It's necessary for several reasons:
When is the best time to prune a tree? The ideal time for pruning varies depending on the tree species and the type of pruning required. For many deciduous trees, late winter or early spring (when the tree is dormant) is often ideal. However, certain trees, like cherries or plums, are best pruned in summer to reduce disease risk. JDB can advise on the optimal timing for your specific trees.
Can you save a tree after storm damage? It depends on the extent of the damage. Minor damage, such as broken small branches, can often be pruned to help the tree recover. Severe damage, like a split trunk or major limb loss, may render the tree too hazardous or compromised to save. JDB can assess storm-damaged trees and recommend the best course of action.
What services do you offer? We offer a comprehensive range of arboricultural services, including:
What is the difference between a tree surgeon and an arboriculturist/tree consultant? A tree surgeon (or arborist) is typically focused on the practical, hands-on work of tree care, such as climbing, pruning, and felling. An arboriculturist or tree consultant possesses a deeper, academic understanding of tree biology, pathology, and legislation. They primarily provide expert advice, conduct surveys, diagnose tree issues, and advise on planning matters. JDB offer both practical tree surgery and expert consultancy services.
Are you insured? Yes, we are fully insured with comprehensive public liability insurance, ensuring peace of mind for our clients. We can provide proof of insurance upon request.
Are your staff qualified? Absolutely. Our team holds relevant industry qualifications, including NPTC (City & Guilds) certifications for chainsaw operation, tree climbing, and aerial rescue. Our management team are qualified to a minimum of Level 4 (e.g., Professional in qualification in Arboriculture or equivalent). We also adhere to the latest health and safety standards.
How do I get a quote for tree work? Please contact us by phone or email to arrange a site visit. We will assess your trees, discuss your requirements, and provide a detailed, no-obligation quote.
Do you clear up after the work is complete? Yes, as standard, we ensure that all tree debris (branches, wood chippings, etc.) is removed from your property, leaving the site clean and tidy. If you prefer to keep wood or chippings, please let us know during the quotation stage.
My neighbour's tree is overhanging my property. What can I do? You have the common law right to prune branches that overhang your property, up to your boundary line, provided the tree is not protected by a TPO or in a Conservation Area. You must offer the pruned branches back to your neighbour. However, we always recommend discussing any concerns with your neighbour first to maintain good relations. You cannot trespass onto their property to prune the tree, nor can you damage the tree in a way that would kill it or make it unstable.
My neighbour's tree is blocking my light/affecting my TV signal. Can I make them prune it? Unfortunately, there is no general legal right to light or a clear TV signal from a neighbour's tree in the UK. While you can discuss your concerns with your neighbour, they are not legally obligated to prune the tree for these reasons unless it is causing a statutory nuisance (which is a high threshold to meet).
Who is responsible if my tree falls onto a neighbour's property or into the road? As the tree owner, you have a "duty of care" to ensure your trees are safe and do not pose a foreseeable risk to others or property. If a tree falls due to a lack of reasonable inspection and maintenance on your part, you could be liable for any damage caused. This is why regular tree inspections are important, especially for trees near targets. If a tree falls into the road, the Highways Authority will likely clear it, but you may still be liable for damages or costs if negligence is proven.
Do you offer emergency tree services? Yes, we provide emergency call-out services for hazardous trees that pose an immediate risk to life or property, especially after storms. Please call our emergency number 01189 733943 for urgent assistance.
